‘Mr. Social Security’ Pleads Guilty To Fraud

Conn’s Hotties are no more, as Eastern Kentucky lawyer Eric Conn admitted in court that he falsified more than 1,700 social security disability applications that are worth as much as $550 million in lifetime benefits.

In 2011, a whistleblower first drew attention to the long-running scam, which included Mr. Conn, a stable of psychologists and doctors (including Alfred Adkins) who filed false reports, and a judge (David Daugherty) who approved the applications without even holding hearings. Mr. Conn, who faces a July sentencing date, has already been ordered to pay $31 million in civil penalties, restitution, and damages; Mr. Adkins and Mr. Daugherty have yet to have their days in court. In court documents, Mr. Conn accused Mr. Daugherty of masterminding the plot, after he allegedly approached Mr. Conn for a $5,000 payment and threaten to deny Mr. Conn’s petitions out of hand if payment wasn’t forthcoming. The two eventually agreed for the judge to receive $400 per approved application. As authorities began to close in, Mr. Conn destroyed most of his records and produced a false video to discredit the whistleblower. So far, government auditors have determined that about half of Mr. Conn’s cases were meritorious. As many as nine people committed suicide after they learned that their social security disability benefits might be terminated.

The Changing Face Of Kentucky Nursing Homes

As society struggles to find innovative ways to deal with an aging population, the future of elder care may be a process as opposed to a place. However, the potential for elder abuse will be just as high.

Every day, roughly 10,000 Americans turn 65. 70 percent of these individuals will require living assistance, and a large number of these people will stay in a nursing home for at least five years. To deal with the exploding elder care issue, some advocates support a continuum of care idea. According to the Department of Health and Human Services, a continuum of care is “less a facility and more a concept” that includes hospice care, full-fledged nursing homes, assisted living facilities, rehabilitation clinics, and counselling/social support services. Another new idea, the Village to Village movement, began in Boston in the early 2000s. This movemenr is dedicated to ending lonliness among older people by keeping these individuals plugged into their communities. Adult day care centers are a significant component.

IVC Filter Use Falls As Lawsuits Increase

A recent study found a direct connection between legal activity and less-frequent use of dangerous IVC filters.

The most significant decline occurred in heavy litigation areas, according to Dr. Ketan Patel of Rush University Medical Center in Chicago. Between 1993 and 2010, IVC filter implants increased almost 10 percent a year; after 2010, when the Food and Drug Administration issued a stern warning and lawsuits began to pile up, IVC filter use fell by more than 7 percent annually.

As Seen On TV: Media Ads Increase Supplement Sales

Even though there may be more evidence to support serious side effects than product efficacy, the “low-T” ads prominently featured on television have caused a surge in testosterone supplement sales, according to a recent study.

Most of the ads ran in the southeast and Great Lakes region, where some men saw up to fourteen commercials a month, or 200 such commercials during the study period. The study concluded that every commercial triggered an increase in testosterone testing, new prescriptions, and especially in prescriptions without testing. Dr. Richard Kravitz, who sits on the faculty at the University of California-Davis, said that this latest testosterone study underscored the sometimes harmful effects of patient advertising.

Deadly Rear-End Crash Raises Liability Questions

One person is dead after a commercial truck swerved into another lane of traffic and caused a traffic collision.

According to witnesses and authorities, a 2010 International Box Truck was southbound on Interstate 75 between Houston and Turfway roads in Boone County when the truck experienced mechanical issues. The driver suddenly swerved over to the right, crossing directly into the path of an oncoming work truck. The driver of the second vehicle — 50-year-old victim from Union — was declared dead at the scene.

Police do not expect to file charges.

How To Defend A Criminal Case

To obtain the best result possible under the circumstances in any criminal defense matter, an attorney must closely scrutinize both the law and the facts. A recent story from Louisville illustrates this process.

Authorities charged 38-year-old Lamberto Mendoza-Valle with muder and DUI-Fourth after a wreck near the intersection of Oakwood and Taylor. According to police, Mr. Mendoza-Valle said he drank eight beers at a friend’s house before driving home unaware that there was a passenger in the car’s back seat. He said he was speeding when another vehicle cut him off, forcing the collision.

Fatal SMIDSY Crash In Allen County

A moped rider is dead after a vehicle operator turned into his lane, causing the fatal motorcycle wreck.

The crash happened near the intersection of U.S. 231 and Dry Ridge Road in Scottsville. According to police, 26-year-old driver moved from the left lane of U.S. 231 into the right lane, and in so doing, rear-ended a 32-year-old driver, who was riding a moped. The force of the motorcycle wreck threw the driver off the bike, and he was later declared dead at a Nashville hospital.

More Victims Filing Risperdal Lawsuits

Janssen Pharmaceuticals, a division of Johnson & Johnson, is facing 40 percent more Risperdal serious side effect lawsuits today than it did just a year ago.

The lead attorneys in Philadelphia have added more than 500 new suits to the docket since the beginning of 2017. J&J lawyers are now even more aggressive in the wake of a $70 million verdict in March 2017; before then, the company had settled many of these actions for as little as $2,000 a case. One source says that J&J is refusing to settle and doing “whatever it takes” to win cases, such as bringing a new stable of expert witnesses to court. On top of the Risperdal lawsuits, the company is dealing with multiple verdicts regarding the link between talcum powder and ovarian cancer, in addition to an ongoing parade of defective hip implant cases. There are more claims on the horizon as well, as the first Xarelto  trial is scheduled to begin in April 2017; these victims claim that the blood thinner causes uncrontrolled bleeding.

Hope For Mesolthelioma Victims

Although the cancer is still one of the deadliest diesases known to man, mesothelioma survival rates have inched up in recent years, largely because of new available treatment options. Palliative chemotherapy has increased significantly since 2016, effectively replacing radiation treatments among healthier patients. Effective surgical interventions have increased as well, though they are an option only in a limited number of cases. One study concluded that a battery of surgery to remove the cancer, light-based photodynamic therapy to kill any remaining cancer cells, and chemotherapy yielded a survival rate of nearly four years; the rate nearly doubled if the mesothelioma had not spread...

California Restricts Roundup Sales

Now, retailers in the Golden State cannot sell Monsanto’s popular weed killer without warning future buyers that this potentially dangerous product may cause cancer.

In January 2017, Superior Court Judge Kristi Culver Kapetan heard arguments from both sides regarding glyphosate, an odorless and colorless substance that is Roundup’s main ingredient. The prestigious International Agency for Research on Cancer recently added glyphostate to a list of cancer-causing chemicals, prompting state officials to order a warning label. Monsanto insists that the chemical is safe, pointing to a U.S. Environmental Protection Agency finding that glyphostate is a “low toxicity” chemical; however, the EPA does advise people to stay away from fields sprayed with Roundup for at least twelve hours.

Roundup is sold in more than 160 countries and used on over 250 varieties of crops and grasses.
